Is CBD Legal in England? The 2026 UK Guide

The 1mg THC rule, why “0.2%” is a myth, novel food rules and the FSA public list, CBD flower, vapes, driving and travel: what makes a CBD product legal in England.

The short version

The short version

Yes. CBD is legal in England when the finished product contains no more than 1mg of THC (and other controlled cannabinoids) in the whole container, and makes no medical claims. Food products such as oils and gummies must also be on the FSA’s public list.

CBD flower (hemp buds) is not legal to sell or possess for consumption, the “0.2% THC” rule doesn’t apply to products, and prescription cannabis medicines are a separate legal route.

CBD is widely sold across England, from high-street chemists to online shops. But the law around it is more specific than many people realise, and plenty of products on sale don’t comply. This guide explains the rules in plain English. It covers England and Wales. Scotland and Northern Ireland have their own food regulators, but the drug laws are UK-wide. This is general information, not legal advice.

The three tests a CBD product must pass

RuleWhat it meansLaw / regulator
1. THC limitNo more than 1mg of THC (and other controlled cannabinoids such as CBN) in the whole containerMisuse of Drugs Regulations 2001, “exempt product” rule. Home Office
2. Novel food authorisation (foods only)CBD oils, gummies, capsules and drinks must be linked to an application on the FSA’s public listNovel Foods Regulation. Food Standards Agency
3. No medical claimsCan’t claim to treat, prevent or cure any conditionHuman Medicines Regulations. MHRA

The “0.2% THC” myth

You’ll often read that CBD products are legal if they contain “less than 0.2% THC”. That figure relates to licensed hemp cultivation: approved hemp varieties must contain no more than 0.2% THC. It doesn’t apply to finished products. For a CBD oil, gummy or vape, the legal test is the total amount of THC in the container: 1mg or less. A product could be 0.1% THC and still be illegal if the container holds more than 1mg in total.

Novel foods and the FSA public list

Since 2019, CBD extracts in food have been classed as novel foods. Products that were on sale before 13 February 2020, and linked to a valid application, can stay on sale while the FSA assesses them. These appear on the FSA’s public list of CBD products. Products not on the list shouldn’t be sold as food. The FSA also advises healthy adults to have no more than 10mg of CBD a day.

Medical cannabis is different

Since November 2018, specialist doctors in the UK can prescribe cannabis-based medicines, including higher-THC products. These are prescription-only medicines, separate from shop-bought CBD. The licensed CBD medicine Epidyolex is used for certain rare epilepsies. See the NHS guide to medical cannabis.

Driving, work and travel

  • Driving: CBD isn’t covered by drug-driving limits, but THC is, and the limit is very low. Don’t drive if CBD makes you drowsy. Read CBD and driving in the UK.
  • Drug tests: tests look for THC. See does CBD show up on drug tests?
  • Travel: CBD laws vary hugely between countries, and some treat it as a controlled drug. Check the rules at your destination before taking CBD abroad.
  1. Look it up on the FSA public list (food products).
  2. Check the independent lab report shows THC within the 1mg limit for the whole product.
  3. Avoid products making medical claims.
  4. Avoid hemp flower and “legal high” cannabinoids.
  5. Buy from UK retailers with clear labelling and contact details.

Laws differ by country, and some treat CBD as a controlled drug. Check the rules at your destination and with your airline before travelling.
