Are CBD Edibles Legal in the UK? Gummies, Chocolates and Drinks Explained

The rules for CBD gummies, chocolates, drinks and other edibles: novel food status, the FSA public list, the 1mg THC limit, labelling, and why THC “edibles” are a different matter.

The short version

The short version

CBD edibles are legal in the UK when they’re linked to the FSA’s public list of novel food applications, contain no more than 1mg of THC (and other controlled cannabinoids) per pack, and make no medical claims.

THC edibles, the kind sold as “weed gummies”, are illegal in the UK, as are HHC and similar “legal high” sweets. The FSA advises healthy adults to have no more than 10mg of CBD a day.

“Are CBD edibles legal?” is a common question, and this guide answers it using UK guidance and the latest evidence. CBD gummies, chocolates, drinks and baked goods are now widely sold in the UK. But “edible” can mean very different things depending on what’s in it. This guide explains which edibles are legal, which aren’t, and how to tell the difference. It covers food products specifically. For CBD law in general, see is CBD legal in England? This is general information, not legal advice.

THC sweets sold illegally often look like branded confectionery and have caused children to be hospitalised. HHC, THC-O and delta-8 gummies aren’t legal CBD either. If a child eats an unknown edible, call NHS 111 or 999 in an emergency.

  1. Novel food status. CBD extracts are classed as novel foods. To be on sale, an edible must be linked to an application on the FSA’s public list of CBD products. Products not on the list shouldn’t be sold.
  2. THC limit. Under the Misuse of Drugs Regulations “exempt product” rules, the whole pack can contain no more than 1mg of THC and other controlled cannabinoids. The “0.2% THC” figure applies to hemp farming, not to products. See the Home Office drug licensing factsheet.
  3. No medical claims. Edibles can’t claim to treat anxiety, pain, sleep problems or any other condition.
  4. Food labelling. Ingredients, allergens, the CBD content, a batch number, a best-before date and the business name and address must be shown.
  5. Consumer advice. The FSA advises healthy adults to have no more than 10mg of CBD a day, and that people who are pregnant, breastfeeding or taking medication shouldn’t take CBD unless advised by a doctor.

  • Search the FSA public list for the product or brand.
  • Check the independent lab report shows THC within the 1mg-per-pack limit.
  • Look for full UK food labelling and a UK business address.
  • Avoid anything making health claims or packaged to look like well-known sweet brands.
  • Buy from established UK retailers, not social media sellers.

Other things to know

  • Drug tests: tests look for THC, so full-spectrum edibles carry a small risk. See does CBD show up on drug tests?
  • Travel: CBD edibles may be illegal in other countries. Check before you fly.
  • Children and pets: keep edibles locked away. CBD products for animals are veterinary medicines, so don’t give human edibles to pets.
